They had to lay off many people before, but now it's confirmed that the company is done. I wasn't a huge Drawn to Death fan, but I appreciated his doing something different, and I feel badly for his coworkers/friends at the company.  
Sucks. Drawn to death has been on my backlog for a long time, I should try it.

Well it sucks but Drawn to Death was a terrible idea for a new studio. You can't alienate 90% of your possible market immediately by making the game absolutely horrific to look at.

There's nothing wrong with prototyping something and using it as a pitch.  I mean, if you have something working, you can go to whoever (In this case Marvel) and be like "Here we have this working, you can try it, this is the money we need to finish it".  Now releasing this information after your studio closes... that's a different issue.

Like dark said, but it's still risky. If marvel says no then you can't just pitch it to someone else. Convert it to a non Marvel game and no one would care.
